These terms apply to olivebranchwaco.com, run by The Stewart Branch LLC, doing business as The Olive Branch ("The Olive Branch," "we," "us"), 215 S. 2nd Street, Waco, Texas 76701. By using our website or buying from our online store, you agree to these terms. If you don't agree, please don't use the site.
1. Menus, prices, and hours
We work to keep our menus, prices, specials, events, and hours current, but they change, and the website may not always match what's in the restaurant. In the restaurant, the current menu and posted prices apply.
2. Allergies and dietary needs
Our kitchen handles common food allergens, and menu descriptions may not list every ingredient. If you have a food allergy or dietary restriction, please tell your server or our catering team before you order. We cannot guarantee that any item is free of allergens.
3. Catering, events, and tickets
Sending a catering or event inquiry does not book anything. A catering order or event is confirmed only when we confirm it in writing, and the quote or agreement we send you governs pricing, deposits, cancellations, and other details. Tickets for special events, such as our Chef's Dinners, are subject to the terms stated when you buy them.
4. Online store
When you order from our online store, you agree to pay the listed price plus any tax and shipping. We may refuse or cancel an order, for example if an item is out of stock or a price was listed in error. If we cancel an order you have already paid for, we will refund you. Payments are handled by our payment processor. Our Return Policy and Shipping Policy are part of these terms.
5. Rewards and promotions
Our rewards offer is run by inKind and is subject to inKind's terms. Specials and promotions are subject to the conditions stated with them and may change or end at any time.
6. Using our site
Please don't misuse our website. That includes trying to disrupt or overload it, accessing areas you aren't authorized to use, scraping it, or using it for anything unlawful. If you send us feedback or ideas, we may use them without owing you anything.
7. Our content
The Olive Branch name, T·O·B, our logos, photos, menus, and other content on this site belong to us or the people who licensed them to us. You're welcome to view and share our pages for personal use, but please don't copy or reuse our content for commercial purposes without our written permission.
8. Other websites
Our site links to services we don't control, such as Grubhub, inKind, Instagram, Facebook, Yelp, and Google Maps. Their terms and privacy policies apply when you use them, and we are not responsible for them.
9. Disclaimers
Our website is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the site will be uninterrupted or error-free.
10. Limitation of liability
To the extent the law allows, The Olive Branch and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website. Our total liability for any claim related to the website or an online order is limited to the amount you paid us for that order, or $100 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in McLennan County, Texas, and you and we agree to those courts' jurisdiction.
12. Changes to these terms
We may update these terms by posting a new version on this page. The date at the top shows when they last changed. If you keep using the site after a change, you accept the updated terms.
